1. INTRODUCTION

This Vehicle Rental Agreement (“Agreement”) is entered into between Kitted Africa (“Company”) and the undersigned renter (“Renter”). By taking possession of the vehicle, the Renter agrees to the terms and conditions set out below.

  1. LEASE OF VEHICLE
    • The Company provides a fully equipped rental vehicle as specified in the booking confirmation. All equipment issued with the vehicle remains the property of Kitted Africa.
    • The Renter may use and operate the vehicle, for the duration of the lease but subject to the terms of this Agreement.
  2. VEHICLE INSPECTION
    • On collection, and upon return of the vehicle, the parties will inspect the vehicle to:
      • Record the condition of the vehicle at the date the Renter receives same; and
      • To determine the condition of the vehicle upon delivery thereof back to the Company.
  1. USE OF THE VEHICLE
    • The Vehicle must at all relevant times be operated in a responsible manner with due regard to the nature of the Vehicle and the road, the rules of the road and traffic conditions.
    • The Vehicle may not be used outside the boundaries of the Republic of South Africa or be taken across the border into another country without the Renter having applied for and having received the Company’s written consent thereto in advance. The Renter will in such event be bound to such additional conditions as the Company may require.
    • Smoking is not allowed in the Vehicle. The Lessee will be liable for a cleaning / deodorising fee if it is found that the vehicle was smoked in.
    • No alcohol may be consumed in the Vehicle.
    • The Vehicle may only be operated on public or official roads, maintained gravel and dirt roads.
    • The Renter agrees not to drive through deep water.
  1. AUTHORISED DRIVERS
    • Drivers must be in possession of a valid and suitable unendorsed driver’s license issued by his/her country of residence and such license must have been valid for a minimum of 1 year.
    • Drivers will be responsible to present the Company with copies of their Identity Documents and/or Passports.
  2. DAMAGE TO OR LOSS OF THE VEHICLE AND EQUIPMENT, AND INSURANCE
    • In case of a collision, accident, theft or loss of or involving the Vehicle or Equipment, the Renter must:
      • Report the event to the Company within 12 hours or if the accident takes place after 18h00 PM, by no later than 12h00 PM of the next day;
      • Report the event to the Police (and before leaving the place where the accident occurred in the event of an accident); and Complete statements as required by the Police and the insurer;
      • Submit and complete all forms required by the insurer and by no later than 24 hours from the incident occurred;
      • Assist the Company and the Insurers to deal with any matters arising from the incident, whether directly or indirectly.
  1. INDEMNITY
    • The Renter acknowledges that the use of the vehicle, associated equipment, and all activities undertaken during the rental period are entirely at their own risk. The Renter accepts full responsibility for their personal safety and the safety of all passengers.
    • The Company, its owners, employees, and partners shall not be held liable for any injury, loss, damage, or death arising from the use or misuse of the vehicle or equipment, or from environmental, wildlife, road, or weather-related incidents. The Renter indemnifies the Company against any resulting claims or legal actions.
    • The Company and its members, officers, employees, servants or agents shall not be liable for any damage or loss, irrespective of the cause, arising out of any defect in or mechanical failure of the vehicle or the driving or use thereof.
    • The Company does not accept any liability for any loss of or damage to any property transported in or left in the Vehicle or any other damages or loss as a result of the conveyance of the driver and/or any other passengers.
    • The Renter hereby indemnifies the Company or its members, officers, employees, servants or agents against any claim of any nature whatsoever and howsoever arising for any damages or loss which might be instituted against us arising from or connected with or pursuant to the renting of the vehicle contemplated in these terms and conditions.
